Marina Etiquette and Rules
The Club at Windward takes the safety and security of you and your vessel very seriously. The Club at Windward has established new rules and regulations that will assist in our mission to follow through with our endeavor. The compiled rules and regulations will be enforced for your safety and the satisfaction of our marina members. We are embarking on a new year which entails some new procedures and rules. Here are The Club at Windwards revised Rules and Regulations.
Boat Sale Procedures
The Slips are property of The Club at Windward, therefore The Lease created by this Agreement and the rights granted hereunder are personal to the Lessee. Lessee may not assign all or any part of its rights under this Agreement, or otherwise sublet or Sell the Designated Boat Slip, or any part thereof, without the prior written consent of The Club at Windward, which consent may be withheld or denied in The Club at Windward sole discretion This Lease shall be binding upon and inure to the benefit of Lessor and its successors and assigns.
The Club at Windward maintains an active waitlist. Due to the high demand for slips, The Club at Windward requires any Leesee who wants to sell their boat to notify Club management. The Club at Windward will oversee the sale of the vessel using our waitlist. If a suitable buyer can not be found by an agreed upon date, we will allow seller to then offer the vessel to an outside party provided
The purchaser must be a Windward resident.
The purchaser must abide by Marina rules and pay any fees associated with membership agreement.
Any unauthorized transfer will result in the new owner having to move the vessel off The Club at Windward property.
Boat Maintenance Standards
Boat items and accessories, including but not limited to, canvas canopies, seats, sails and boat furniture must be maintained in a neat and attractive condition.
Trash left on or around boats must be disposed of in proper receptacles and out of view from the dock. Under no circumstances are grass clippings, leaves or any other yard debris to be thrown in the lake.
Boats must be well maintained and free from excessive damage, dirt, mildew or mold.
Sunken or partially sunken paddle boats, canoes, pontoon boats, sail boats, etc. are not permitted. All such craft are subject to removal from Windward Lake at the owner's expense.
All boats must display a WSCA boat decal permanently attached to the body or hull of the boat for purposes of identification.
Basic Rules
The Club at Windward Marina is for the exclusive use of its members only.
All Guests must be accompanied by a club member and must adhere to the rules and regulations when using the marina or on any property that is owned by The Club at Windward LLC.
In an event a key card is lost you must contact The club at Windward or email marina@windwardlakeclub.com. Boat owners are responsable for damage incurred while a key card is used without their authorization.
Slip assigned must be kept free of garbage and debris. Personal Property shall not be stored upon the deck or adjacent to the dock, walkway, parking lot or grounds. The use of trash receptacles are strictly enforced.
All boats are required to be moored safely and securely. Vessel is required to be secured with two (2) lines, one line keeping the bow of the boat from making contact with the dock. Boat owners are solely responsible to keep lines free of excess slack. Marina assumes no responsibility for improperly moored boats, improperly tied lines and members must possess proper buoys on port and starboard sides of the vessel. The marina reserves the right to replace defective lines when necessary, as well as absence of buoys and charge boat owners for the cost of replacement. Boat owners will be given 30 days to comply.
Boat owners authorize the Marina to move any vessel in an event of emergency or avoid loss or damage to marina property and owner further agrees that Marina shall not be liable for any damage to the boat caused by such moving of the boat.
Any abandoned boat left at The Club at Windward Marina after moving from the community shall give up any and all rights to the marina. The boat will then be governed by The Club at Windward LLC and TCW holds the right to make necessary decisions for the removal or storage of such boats (with any related costs being billed to the last boat owner) so that current or potential renters have every opportunity to rent that water slip.
Any new renter shall be charged as follows. Renting space between months of January-June shall pay the full yearly rent amount. Any space taken between the months of July-December shall pay 1\2 of the yearly rental amount.
The Club at Windward LLC is not responsible for damage from fire, theft, vandalism, storms, collisions or sinking of vessels for any reason. TCW LLC accepts no responsibility for damage caused by power outages or surges, brown outs, weather, lightning, winds, floods or any other act of Mother Nature whatsoever.
All vessels are required to be registered through WCSA. The Club at Windward does not provide registration stickers. WCSA will provide you with a registration sticker that needs to be adhered to the bow of the boat in plain view. The Club at Windward works closely with WCSA in order to ensure all vessel owners adhere to this rule.
All boats on The Club at Windward marina are required to have permissive boat insurance with a minimum coverage amount of $300,000.
All co-owners of any one vessel must be registered in The Club at Windward’s database for security purposes. Each co-owner must provide proof of residency in Windward Lake Club.
No children under the age of thirteen (13) will be permitted on the boat docks without adult supervision. Youths under 21 are not permitted on boat docks without adult supervision after dusk. Members are responsible for the conduct of its family members and guests.
Any driver of a vessel is required to possess a valid driver’s license. At any time, membership can be revoked if unlicensed drivers operate their boats.
The speed limit is 5 mph (miles per hour) strictly enforced by WCSA and The Club at Windward.
No Fishing from docks.
All dock doors must be closed and secured at the time of entry and exit. Failure to do so will result in fines and or suspension of membership.
Washing boats such that non-environmentally friendly soap, detergents, cleaners, solvents or other chemicals being discharged into the lake or anywhere onshore upon premises is prohibited.
All Rules and regulations have the right to change at the sole discretion of The Club at Windward management.
At any time, The Club at Windward has the right to rescind membership for infraction of the rules and inappropriate use of the membership privileges by its family members and guests.
Any new member shall be charged as follows. Membership dues between the months of January-June shall pay the full yearly membership amount. Any membership purchased between the months of July-December shall pay 1⁄2 of the yearly rental amount.
